Whose children are they?  His or hers?

A recent news item had a mother and a couple of heavies chase her estranged husband to the Middle East to retrieve her two children he had taken.   Her two children?

Islamic law caught up with them before the return flight and gave custody to the father.

Questions: Why?  On what basis?  Whose children are they, really?

Well, our Creator and Father of humanity Jehovah has it that children belong to the life giver, the father, as documented in the manual given to Israel, where all the legal parameters and principles pertaining to family identity and inheritance were established.

Islam is obviously aware of that and legally enforced that through the courts.

Israel most certainly was aware of that on the basis of their Law Covenant, but the disobedient leftovers from the cataclysms brought upon them by the Babylonians and Romans left little authority and almost zero prospects for attaining to their presumed to exist godly right to rule.

In consequence, they gradually ingratiated themselves into European and sundry royal families by changing their Jewish family identity line of descent through the maternal line in keeping with their global power politics agenda on the basis of a presumed right to rule through a deliberate misinterpretation of Jehovah's promises to Abraham and the fathers of Israel.

Royal progeny became Jewish by default to globalise government and finance.

A little more about the female of the species:

The almost prophetic repercussions of the whole uncooperative behaviour of the first two humans included a measure of female envy of and desire for the leading role assigned the man Genesis 3:16.

Alas, along with man's role of life giver and creator of family came his responsibility for the family before God to whom he had to answer.  More about this here.

Women, the perfect complementary companion of the man, are nonetheless just the passive means for their haploid ova to receive life and a haploid from the male of the species, whatever his qualities and status from nitwit to genius.

Life is not theirs to give.   Theirs is to receive, nourish and love it.

Life is simply passed on from God via the man, who did not design that for himself to brag about it.

Not man's fault.  They were made that way for genetic tracing and family inheritance.

All progeny, offspring, children become integral with the father's family, occupation and tribe which gave them life, identity and generally the family surname, a practice, or custom that has survived to this day whatever their current means of garnering a living. The female bearer and feeder of the offspring likewise became integral with the father's family/tribe as well as the default change of surname for succour and protection.

Children never belong to the mother's tribe, for mothers are not the source of life.

As for: Whose children are they?  His or hers?

Simply:  His!

Now finally in praise of woman, created in God's image, genius,
good wife and mother as intended, here via the King James Bible
after some good advice to Kings:

01  The words of king Lemuel, the prophecy that his mother taught him.

02  What, my son? and what, the son of my womb? and what, the son of my vows?

03  Give not thy strength unto women, nor thy ways to that which destroyeth kings.

04  It is not for kings, O Lemuel, it is not for kings to drink wine; nor for princes strong drink:

05  Lest they drink, and forget the law, and pervert the judgment of any of the afflicted.

06  Give strong drink unto him that is ready to perish, and wine unto those that be of heavy hearts.

07  Let him drink, and forget his poverty, and remember his misery no more.

08  Open thy mouth for the dumb in the cause of all such as are appointed to destruction.

09  Open thy mouth, judge righteously, and plead the cause of the poor and needy.

10  Who can find a virtuous woman? for her price is far above rubies.

11  The heart of her husband doth safely trust in her, so that he shall have no need of spoil.

12  She will do him good and not evil all the days of her life.

13  She seeketh wool, and flax, and worketh willingly with her hands.

14  She is like the merchants’ ships; she bringeth her food from afar.

15  She riseth also while it is yet night, and giveth meat to her household, and a portion to her maidens.

16  She considereth a field, and buyeth it: with the fruit of her hands she planteth a vineyard.

17  She girdeth her loins with strength, and strengtheneth her arms.

18  She perceiveth that her merchandise is good: her candle goeth not out by night.

19  She layeth her hands to the spindle, and her hands hold the distaff.

20  She stretcheth out her hand to the poor; yea, she reacheth forth her hands to the needy.

21  She is not afraid of the snow for her household: for all her household are clothed with scarlet.

22  She maketh herself coverings of tapestry; her clothing is silk and purple.

23  Her husband is known in the gates, when he sitteth among the elders of the land.

24  She maketh fine linen, and selleth it; and delivereth girdles unto the merchant.

25  Strength and honour are her clothing; and she shall rejoice in time to come.

26  She openeth her mouth with wisdom; and in her tongue is the law of kindness.

27  She looketh well to the ways of her household, and eateth not the bread of idleness.

28  Her children arise up, and call her blessed; her husband also, and he praiseth her.

29  Many daughters have done virtuously, but thou excellest them all.

30  Favour is deceitful, and beauty is vain: but a woman that feareth the LORD, she shall be praised.

31  Give her of the fruit of her hands; and let her own works praise her in the gates.

In the Authorised Version King James Bible Hebrew Old Testament and other versions, LORD refers to Jehovah, as demonstrated in the only 4 verses that render it such in the AV:

Exodus 6:3  —  Psalms 83:18  —  Isaiah 12:2  —   Isaiah 26:4:

May all women relish their place of beauty and intent in Jehovah's universe forever, even as men need to, for fulfilment and a happiness humanity can barely perceive.
